These Subscription Terms and Conditions (“Subscription Terms”) govern your purchase, renewal, use and cancellation of any subscription-based access to LoadLink Australia Services. These terms form part of the overarching Terms of Use and must be read in conjunction with that document. Where there is any inconsistency, these Subscription Terms take precedence in relation to subscription matters.

1. DEFINITIONS

• Subscription means paid access to specific features, services, or tools provided via Our Website or Online Services for a defined recurring period.
• You / Your means the person or entity purchasing or using the subscription.
• We / Us / Our refers to LoadLink Australia Pty Ltd (ABN 30 007 423 312).
• Billing Period means the frequency with which subscription fees are charged (e.g. monthly, annually).
• Services means the features and access provided to You under a valid subscription.

2. SUBSCRIPTION SERVICES

2.1 Subscription access grants You the right to use certain features or services for the duration of the applicable Billing Period. The specific inclusions and pricing for each subscription tier will be communicated prior to purchase.

2.2 Subscriptions are made available on a paid basis and are subject to timely payment.

3. BILLING AND RENEWAL

3.1 Subscriptions are billed in advance and renew automatically at the end of each Billing Period unless cancelled in accordance with Clause 4.

3.2 By subscribing, You authorise Us to charge the applicable fee to Your nominated payment method.

3.3 If payment fails or is declined, We may suspend or cancel Your access to the Services until payment is received.

3.4 Pricing and inclusions are subject to change with notice. We will provide advance notice of any pricing changes, which will take effect from Your next Billing Period.

4. CANCELLATION

4.1 Cancellation by You: You may cancel a subscription at any time by written notice to Us or via Your account interface (if available). Cancellation takes effect at the end of the current Billing Period. No refunds are provided for unused time.

4.2 Cancellation by Us: We reserve the right to cancel or suspend a subscription at any time for a breach of any applicable terms or if required by law. In such cases, no refund will be issued.

5. REFUNDS AND NON-REFUNDABLE FEES

5.1 Subscription fees are strictly non-refundable, including for periods where the Services are not used, cancelled early, or accessed in part only.

5.2 No credits, transfers or pro-rata adjustments will be applied, except where required by the Competition and Consumer Act 2010 (Cth) or any other legislation which cannot be excluded.

6. TERMINATION AND ACCESS

6.1 Upon cancellation or termination, Your access to the Services will continue until the end of the current Billing Period.

6.2 Following expiration, We may revoke access to any Service features linked to the subscription.

6.3 We reserve the right to delete any data associated with an expired or cancelled subscription after a reasonable period.

7. AUSTRALIAN CONSUMER LAW

7.1 These Subscription Terms do not limit Your rights under the Australian Consumer Law. Where any term is found to be void or unenforceable under such legislation, that term will be severed, and the remainder will continue in effect.

7.2 To the extent permitted by law, Our liability for breach of a consumer guarantee is limited to the resupply of the Services or a refund of the subscription fee, at Our discretion.
